Supreme Court says no to drug companies

Conservative Justice Clarence Thomas joined the more liberal Justices in this decision. The decision basically says that a drug maker does not need the authority of the Food and Drug Administration in order to alter a warning label to make it clearer, more explicit and more safe.

NOW THEREFORE, drug companies are also not immune to lawsuits by relying solely on product labeling established by the FDA.

The dissenting Justices argued that this undermines the FDA's regulatory authority.

Least that's how I read it. I'm not a lawyer though.

The Supreme Court, voting 6-3, ruled on Wednesday that federal approval of labels giving warnings about effects of drugs does not bar lawsuits under state law claiming inadequate warnings of a health risk. The ruling came in the case of Wyeth v. Levine (06-1249). This was the only decision of the day.

The history of the federal law on drugs shows, Justice John Paul Stevens wrote for the Court, that Congress did not intend to bar failure-to-warn lawsuits that are based on state law. The decision also rejected a claim by the pharmaceutical company, Wyeth, that a 2006 regulation of the Food and Drug Administration expressing concern about the impact of state failure-to-warn lawsuits on federal regulation should mean that such cases are barred. The Court said that, since Congress has not authorized a federal agency directly to preempt state lawsuits, the Court would give less weight to FDA’s views on that issue.

Justice Stevens stressed, however, that the Court was not ruling on the preemptive effect of any official rule that FDA might impose that had the force of law. Justice Stephen G. Breyer, who joined the Stevens opinion, made that comment the centerpiece of his separate concurrence.

Also joining the Stevens opinion were Justices Ruth Bader Ginsburg, Anthony M. Kennedy and David H. Souter. Justice Clarence Thomas wrote separately, supporting only the outcome, not the majority’s reasoning.

Justice Samuel A. Alito, Jr., joined by Chief Justice John G. Roberts, Jr., and Justice Antonin Scalia, dissented. The dissenters said that the majority had turned “a common-law tort suit into a frontal assault on the FDA’s regulatory regime for drug labeling.” read more here

Tech Blog urges NBC's Brian Williams to losen up his wallet and spend a few bucks

I like Brian Williams. I actually enjoy our half hour together that begins at 5:30 PM CST.

I don't think if he took a vacation that I would get all upset about it. I'm glad he's sensitive, but not spending any money isn't good either especially if you got it to spend.

The extravagance of the TARP recipients and the lack of sensitivity to issues affecting everyday Americans is what chaps our buns out here, along with the people who assisted big time in screwing things up being rewarded and continuing to expect to be enriched even as the world for many people is falling away beneath them.

That's what gets us.

As this blogger points out there are ways you can spend your mucho bucks Brian that will actually help us short-term and long-term.


NBC anchor Brian Williams makes $10 million a year, but because he's "sensitive" to the nation's economic woes, he's having a hard time spending it.

He's not going on vacation this year and he told MediaBistro:

"I've had no desire to walk into any store but a grocery store for months. It's just not cool right now to be ostentatious. It doesn't look right. It doesn't feel right. It's not very sensitive to all the suffering that's happening."

We all appreciate your sensitivity, Brian, but start spending please.

The article explains something called the "paradox of thrift," which is what we think Brian is suffering from. Basically, Brian and the rest of society are saving because they're worried about the economy -- and it's killing the economy.

Brian? Please stop that. Start buying things that will help you save money later. Like maybe an Amazon Kindle if you're a big reader. Solar panels on your vacation home would be good too. read more at --Silicon Alley Insider

All you need to do Brian, and I know you can do this, is to turn it into a story. Go out and spend some money and show the rest of us how many people have jobs when we spend. Do some green spending stories, and buy yourself a little something something along the way.

Don't worry either about being accused of being part of the Liberal Media either. We know deep down you are a capitalist at heart. You wouldn't be making 10 million a year if you weren't, and I don't hold that against you.

I bought myself two pairs of pajamas for 20 bucks yesterday. I did my part.

Brian Williams asks Sarah Palin to categorize 'Domestic Terrorism'

It sounds to me, just a peon out here in Indiana, from what Sarah Palin said as she answered this particular line of questioning, is that people will will fall into the category of 'Domestic Terrorists', if they seek to attack and/or destroy 'Federal Buildings', with our without people in them.

She did seem to say that people who bomb abortion clinics would not be considered domestic terrorists.

So then one could infer with respect to 'International Terrorism', that the 9/11 group would only be terrorists as to the Pentagon attack, but as to the Twin Towers, that would not be considered terrorism.

She's not ready. She is not ready at all. I'm not either, but she's definitely not ready to be the President of the United States. No way.

Chuck Todd of MSNBC: "I couldn't see chemistry between John McCain and Sarah Palin."

Some pretty astonishing observations of the McCain-Palin interview with Brian Williams coming out of Chuck Todd's mouth. Astonishing for the fact that he actually said it out loud and on television without mincing words at all.

I watched the first segment of the interview on Nightly News tonight. I didn't see anything different between John McCain and Sarah Palin than I have seen before, except that Sarah Palin seems more at east with being herself these days.

What a long strange trip it's been (as I bizarrely quote The Grateful Dead).
